This is the Situation
Özker Özgür The commandership has so decided. They have found it suitable to turn the house on the Dikmen-Boghaz road to a military apartment. Who and since when have been residing in the house is no concern of theirs. Whether people living in this house allocated according to the laws of the community can or cannot move to another house is no concern of the military. Taking no heed of the human side of the situation and with no respect to the law they have given their orders… Have the house evacuated… Months ago it was brought to the attention of the community in the columns of Avrupa. The columnists dealt with the topic. The desperation of the family living in the house was explained. No-one took notice. Why? Because the commandership wanted the house to be evacuated. Ever since the old days this is what is being injected to the community… Whatever the military says goes. Civilian or not every-one has to obey the orders of the military. If the military have given their orders the running waters must stop running. In the end whatever was to come, came. When the police went to the house to carry out the orders of the military they were encountered with the resistance of three kids between the ages of 10 to 15. Three teen-agers met the police with shot-guns. The youngsters taking up position in the house called out to the police: -We shall shoot anyone who approaches the house. We’ve heard that the commandership of the Security Forces has given time to the government until the weekend to solve the problem. Hear this and come to your senses… Who govern and who are governed you can’t tell. Ballot boxes are set up, elections are held, government’s come, governments go; none can influence the military. All do whatever the military tell them to do. Why? Because it’s not those elected by the people who govern. It’s the civilian and military bureaucrats appointed in Ankara who govern. This is why the Commandership of the Security Forces has given a time limit until the weekend to the government. The meaning of this is clear. The commandership is determined to get the house by force. They want the government to evict the family from the house. The government doesn’t have the guts to say: “-These people are our citizens. We the government allocated the house to them. Neither we nor the commandership have the authority to evict them from the house.” Leave aside being a state based on the rule of law, even under the most primitive state this wouldn’t happen. States of law are based on human rights. Where rule of law prevails no bills contrary to human rights can be passed. But where there is no rule of law bills contrary to human rights can go through. For example Hitler’s state was such a state. The bills passed by Hitler had done away with the right to live of the Jews. We have a constitution and laws. According to the constitution there is the rule of law. Again according to the constitution no one’s home may be intruded upon. This seems to be under the protection of the constitution. But when the military are involved constitutional rights are not valid. What happened in the house on the way from Dikmen to Boghaz proves that in the north of Cyprus there is no rule of law. There are other examples. The case of Yaşar Balcı from Ozanköy is a similar case. His right to property which is said to be under the protection of the constitution is flagrantly violated. His property by the sea is under military occupation. While writing these lines Shener Levent called. He told me that a special police team has raided the house on the way from Dikmen to Boghaz, arrested all the members of the family and thrown all their belongings into the street. We had been told that the commandership had given the government until the weekend. They did not pay any attention to the complaints of the family. They have pushed the constitution and human rights aside. They have formally and actually violated the rights of settlement and privacy of a family. The government is nowhere to be seen. The government is once again helpless. The status quo has shown its teeth. The people are being shown once again what the lack of a solution means. While songs of integration into Turkey are being sung, this is the situation in the north of Cyprus. |
