The Attorney General of the Turkish Republic of Northern Cyprus (TRNC) accuses Avrupa Ltd, Shener Levent editor of Avrupa and columnist Özker Özgür of publishing material contrary to the 20th, 4th (b) and 48th (a) articles of Act 154 of the penal code with the seditious intention of creating hatred against and and humiliating the state.

The accused, on 28.7.1999, on the 8th page of Avrupa, serial numbered 679, sith seditious intention to create hatred against and humiliate the state published the article entitled, “This Is The Situatiopn” bearing the following seditious lines:

“-Whether people residing in a house allocated according to the laws of the community can or cannot move to another house is no concern of the military commandership. The commandership taking no heed of the human side of the situation and without condidering the law have given their orders. The house will be evacuated. Civilian or not every one has to obey the orders of the military. If the military have given their orders the running waters must stop running. The commanders have given one week to the government to get the house evacuated. Can you imagine? Who are the governors and the governed? You can’t tell. Elections are held, governments go and come but none can be influential on the military. It’s the other way round. The military influence the governments and get things done their way. Why? Because it’s not the elected representatives of the people who rule. The civilian and militray bureaucrats appointed in Ankara are the real rulers. The government allocated this house to this family. Neither we nor the commanders are authorised to evict them. Where is the rule of law? The most primitive state wouldn’t do this. When the military are involved the constitutional rights evaporate. What this family has gone through is proof of the fact that in the North of Cyprus there is no constitutional order based on the rule of law. There is no constitution and there are no human rights. The right of settlement and the right of privacy have have been violated. The government is nowhere to be seen. The government is once again helpless.”
